Probate
The administration of the estates of deceased individuals is dealt with by our probate team. It can be a complex process which will usually involve ascertaining the nature and value of the deceased's assets, preparing the probate and inheritance tax papers, obtaining a grant of representation and, after the payment of debts, liabilities, expenses and tax, distributing the estate to those entitled to it under the terms of the deceased's will or the intestacy rules.
We have experience in dealing with more complex issues which can sometimes arise including insolvent estates, investigations into lifetime gifts made by the deceased, resealing foreign grants, questions of domicile, assets situated outside the UK, business and heritage assets, contested wills and deeds of variation.
The lawyers in our team have considerable experience in handling estates. In appropriate cases, partners within the firm are available to act as executors, administrators and attorneys.
