Couples who separate or divorce often find sorting out money and property the most difficult aspect. If a couple can agree an overall financial resolution, it is often with the benefit of expert legal advice and practical support from experienced lawyers. Mediation, the collaborative process and negotiation are all used to try to achieve an overall resolution, even where there are complex assets, such as businesses, pensions etc. Court proceedings are usually the last resort. Once there has been full disclosure of assets, a Judge will have a wide discretion based on the couples needs and resources to divide assets.
